NEW DELHI: The Delhi High Court has reaffirmed that the personal liberty of two consenting adults to marry and live together peacefully is protected under Article 21 of the Indian Constitution.
Delivering the judgment, Justice Sanjeev Narula stressed that family opposition cannot override an adult’s autonomy when it comes to marriage or cohabitation. The court cited multiple Supreme Court rulings that have consistently upheld this principle, instructing law enforcement agencies to shield such couples from any form of harassment, threats, or coercion.
What is the Case?
The matter came before the court after a young couple, married on July 23, 2025, as per Hindu rituals at an Arya Samaj trust in Delhi, sought police protection. The woman’s parents had allegedly tried to pressure her into leaving the marriage despite her voluntary departure from her family home and her clear confirmation of the marriage during a police inquiry.
The police had initially begun an investigation following a missing person complaint, but closed it after confirming the woman’s consent and marital status.

Court’s Directions for Protection
Taking the couple’s safety concerns seriously, the High Court issued explicit directions:
- Appointment of a beat officer by the local Station House Officer (SHO) to ensure the couple’s safety.
- Briefing of police personnel on the court’s protection order.
- Provision of emergency contact numbers to the couple.
- Immediate documentation and action on any reported threats or harassment.
Justice Narula made it clear that the court was not commenting on the truthfulness of the allegations but was focused solely on safeguarding the couple’s fundamental rights to life, liberty, and dignity as guaranteed under the Constitution.
