This directive came from a vacation bench comprising Justices AD Jagadish Chandira and R Kalamathi, following a habeas corpus petition filed by Shankar’s mother, A Kamala.
The petition raised serious concerns, alleging that Shankar was assaulted while in judicial custody at the Coimbatore Central Prison. Kamala’s plea, represented by Senior Advocate R John Sathyan, called for a judicial inquiry into the purported acts of violence.
In her petition, Kamala claimed that Shankar was wrongly arrested by the Coimbatore Cyber Crime Police on May 4, citing his critical remarks about women police personnel in a YouTube channel interview. The arrest has since escalated concerns about his treatment and safety while detained.
Providing further details to the court, Advocate Sathyan explained that Shankar was medically examined and declared fit prior to his arrest. However, disturbing allegations emerged when another lawyer met Shankar in prison, where he reported being assaulted and sustaining a fracture on his right arm.
The court, while refraining from immediately calling for a judicial inquiry, chose to await the detailed report from the legal services authority before making further decisions. This step underscores the court’s cautious approach in dealing with claims of custodial abuse, balancing the need for immediate action with the requirement for thorough investigation.
