NEW DELHI: On Wednesday (6th of March): The inauguration session of Delhi Arbitration Weekend (DAW) 2024 witnessed the unveiling of the latest edition of the ‘Delhi Arbitration Review‘ by the Delhi International Arbitration Centre (DIAC). Chief Justice of India (CJI) DY Chandrachud officiated the release ceremony alongside Justices Judith Prakash, Manmohan, Vibhu Bakhru, and Rekha Palli at the Supreme Court auditorium.
The session, titled ‘Understanding the Unsaid: Biases in Arbitration and the Role of Tribunals and Courts,’ attracted a diverse audience, including acting and retired judges, government law officers, Senior Advocates, advocates, and arbitrators.
Acting Chief Justice Manmohan of the Delhi High Court delivered the welcome address, emphasizing the pivotal role of judicial efficacy in arbitration proceedings. He emphasized the need for a global exchange of best practices in light of jurisdictional variations and highlighted the issues of “apparent bias” and systemic bias in arbitration.
Expressing concern over the representation of the Global South in dispute resolution processes, he stressed the importance of inclusivity in countering systemic biases. He noted the growing attention of Indian lawmakers and judges toward addressing apparent bias in arbitration, reflecting the evolving landscape of international trade and commerce.
