NEW DELHI: Deepfakes are a growing global concern, including in India, where regulatory challenges have emerged. While existing laws address some aspects, there is a pressing need for dedicated legislation and regulations. Additionally, raising awareness, developing countermeasures, and establishing a robust legal framework are essential to mitigating the risks associated with this technology.

Deepfakes are AI-generated synthetic media that manipulate videos, audio, or images using advanced deep learning techniques. These hyper-realistic alterations can serve both harmless and malicious purposes. By leveraging machine learning, deepfake technology convincingly modifies a person’s face, voice, or likeness to create fabricated yet highly realistic content.

Deepfakes rely on artificial intelligence applications that combine multiple technologies to generate new audio or video clips. The process involves overlaying, modifying, and merging images, resulting in complex and lifelike media. Deepfake techniques include:

  • Face Reenactment – Altering facial expressions and features.
  • Face Generation – Creating an entirely new, AI-generated face.
  • Face Swapping – Exchanging one individual’s face with another.
  • Speech Synthesis – Replicating voices to produce realistic speech.

Despite their technological advancements, deepfakes raise serious ethical and legal concerns. They can be misused for misinformation, identity theft, and manipulation of public opinion, making regulation crucial to prevent exploitation.

DEEPFAKE TECHNOLOGY

While deepfakes pose risks, they also offer significant benefits across industries:

  • Healthcare – Enhances medical training and diagnostic simulations.
  • Entertainment – Aids in dubbing, CGI, and language localization.
  • Tourism & Marketing – Creates realistic imagery for advertising campaigns.
  • Education & Training – Provides immersive learning experiences.
  • Automotive & AI Development – Assists in self-driving car simulations.

Deepfake technology also reduces content production costs by transforming text into high-resolution images, solving data shortages in various fields. In autonomous vehicle testing, AI-generated deepfake data allows for extensive road simulations at a fraction of the cost.

As deepfake technology continues to evolve, balancing innovation with ethical considerations is essential. Implementing regulations, raising awareness, and developing AI-driven countermeasures will help mitigate risks while maximizing its potential benefits.

The rapid advancement of deepfake technology has raised significant concerns regarding its potential for spreading misinformation. Deepfakes enable the creation of highly realistic yet fabricated videos, audio clips, and images that can be used to mislead audiences.

These deceptive portrayals can damage reputations, manipulate public opinion, and undermine trust in credible information sources.

The 2024 Global Risks Report by the World Economic Forum identifies misinformation and disinformation as the most pressing global threats in the next two years. When used to distort the images of politicians, business leaders, and public officials, deepfakes can erode trust in governmental institutions, legal frameworks, and media organizations.

The easy availability of AI tools like TensorFlow, Keras, and Generative Adversarial Networks (GANs) has facilitated the proliferation of deepfakes, leading to hoaxes, frauds, and government disruptions.

India has faced notable challenges with misinformation due to its extensive internet user base of 323 million people, 67% of whom reside in urban areas.

Limited media literacy has exacerbated this issue, particularly during the COVID-19 pandemic, when false remedies and treatments were widely circulated. One infamous instance involved a viral video promoting cow urine as a cure for COVID-19, despite health authorities discrediting the claim.


Deepfakes have been leveraged to influence political discourse, often shaping public perception of politicians. Fabricated videos portraying politicians using offensive language, engaging in corrupt activities, or making controversial statements have been used to manipulate voter opinions.

Notable examples include a 2019 manipulated video of U.S. House Speaker Nancy Pelosi appearing to slur her speech and deepfake videos of UK politicians Boris Johnson and Jeremy Corbyn falsely endorsing each other for prime minister.

In India, the first known instance of deepfake technology in political campaigning occurred in 2020 when AI-generated videos of politician Manoj Tiwari circulated on WhatsApp, accusing his opponent, Arvind Kejriwal, in multiple languages. In a politically sensitive country like India, deepfakes can exacerbate communal tensions, incite violence, and undermine democratic institutions.

Deepfakes also pose risks to journalism and democracy by making it difficult to distinguish real from fabricated content. The “liar’s dividend” phenomenon allows politicians to dismiss authentic videos as deepfakes, further eroding public trust in information.

If left unregulated, deepfake technology may contribute to political instability, electoral fraud, and public skepticism toward news sources.


Deepfake technology is increasingly being used for cyberbullying, with malicious actors creating deceptive content to harass individuals. Manipulated videos may depict individuals in inappropriate or compromising situations, leading to reputational damage, emotional distress, and mental health issues.

A majority of deepfake content found online is pornographic, often targeting women without their consent. The misuse of this technology originated when a Reddit user began sharing altered videos of celebrities, a practice that has since expanded across various websites.

Deepfake pornography has victimized numerous public figures, including journalists and actors.

This form of cyberbullying can result in blackmail, extortion, and severe psychological trauma. The unauthorized creation and dissemination of such content underscore the urgent need for regulatory interventions to curb its misuse.


Deepfake technology infringes on personal privacy by generating explicit or defamatory content without an individual’s consent. The unauthorized use of personal images and videos violates privacy rights and can have lasting consequences on professional and personal reputations.

Privacy concerns associated with deepfakes include data collection without consent, unauthorized secondary use of personal information, and potential misuse by AI service providers.

The “Right of Publicity,” which protects an individual’s control over their image and likeness, is often compromised by deepfake technology.


Impersonation fraud through deepfakes is an escalating cybersecurity concern. AI-generated simulations of individuals’ faces, voices, and behaviors enable fraudsters to deceive victims for financial gain. Deepfake technology has been used in corporate fraud, with scammers creating fabricated voice or video messages of executives to authorize wire transfers or disclose sensitive information.

In December 2023, the CEO of Zerodha Broking Ltd. highlighted the challenges deepfakes pose to financial services, warning about their potential for identity fraud.

A notable instance of financial fraud occurred in April 2024, when a Mumbai businessman lost INR 80,000 in an AI voice-cloning scam.

Fraudsters impersonated his son using deepfake voice technology, claiming he was arrested in Dubai and required bail money.

Deepfake impersonation also plays a role in phishing attacks, where cybercriminals use AI-generated content to extract personal information, financial details, or login credentials.

The rise of deepfake technology presents significant challenges, necessitating robust legal mechanisms to regulate its use. Currently, India lacks specific legislation addressing deepfakes. However, by taking inspiration from countries like the USA, India can develop a comprehensive framework to tackle the issue effectively.

The United States has taken several legislative steps to counter deepfakes.

  • The Malicious Deep Fake Prohibition Act (2019): Aimed at criminalizing the creation and distribution of deepfake content intended to deceive the public, particularly during elections.
  • The Identifying Outputs of Generative Adversarial Networks (IOGAN) Act (2020): Proposed a task force within the Department of Homeland Security to study deepfake technology and counter its harmful effects.
  • The DEEPFAKES Accountability Act (2023): Focused on protecting national security and providing legal recourse to victims of harmful deepfakes.

The right to privacy is a fundamental human right under Article 12 of the Universal Declaration of Human Rights (1948). In India, this right is protected under Article 21 of the Constitution, as reaffirmed in KS Puttaswamy v. Union of India (2017). This ruling recognizes an individual’s control over their personal information, making unauthorized deepfake usage a violation of privacy rights.

Additionally, the Digital Personal Data Protection Bill (2022) aims to protect personal data and regulate its lawful usage. If passed, the bill could address deepfake-related privacy violations by allowing individuals to seek rectification and removal of unauthorized content.

A major contention between the Indian government and social media companies arises from the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. These rules hold social media platforms accountable for user-generated content and require encrypted messaging services to disclose user identities upon government demand. Social media companies argue that this compromises privacy, while the government maintains it is essential for national security and law enforcement.

The Right of Publicity, also known as Personality Rights, grants individuals control over the commercial use of their name, image, or identity. Although India lacks explicit legislation on this right, courts have recognized it through judicial decisions. In ICC Development (International) Ltd v. Arvee Enterprises (2003), the Delhi High Court ruled that individuals have the exclusive right to benefit from their own persona, including their name, signature, or voice. Unauthorized deepfake usage involving public figures can therefore amount to a violation of this right.

Deepfake technology can be used for identity theft, financial fraud, and defamation. Under the Indian Penal Code (IPC), 1860:

  • Section 420 & Section 468: Address cheating and forgery, imposing penalties of imprisonment and fines for fraudulent activities.

The Information Technology (IT) Act, 2000 contains provisions that can be applied to deepfake-related offenses:

  • Section 66E: Penalizes unauthorized capture and dissemination of private images, with up to three years of imprisonment or a fine of Rs. 2 lakh.
  • Section 66D: Criminalizes identity fraud using digital means, punishable by up to three years of imprisonment and/or a Rs. 1 lakh fine.

The Indian Copyright Act, 1957, amended in 2012, protects various forms of artistic expression. Unauthorized use of copyrighted material for creating deepfakes can result in legal action under:

  • Section 51: Prohibits unauthorized reproduction of copyrighted content, including manipulated videos or images.
  • Derivative Works Rule: Since deepfakes modify pre-existing content, they may constitute derivative works, making unauthorized use a copyright infringement.

Tackling deepfakes requires a multi-faceted approach involving legal, technological, and public awareness initiatives:

  • Legislation: Enacting laws specifically targeting deepfake misuse.
  • Technology Solutions: Promoting AI-driven detection tools for identifying deepfake content.
  • Public Awareness: Educating individuals about the dangers and ethical implications of deepfakes.
  • Industry Collaboration: Encouraging cooperation between governments, social media platforms, and cybersecurity firms to curb the spread of malicious deepfakes.
