Kerala High Court ruled that police can’t reject FIRs just because complaints come via email from overseas without a signature. The Court upheld the right to file Zero FIR under BNSS 2023.
Mumbai, March 19: The Bombay High Court has strongly criticized Mumbai police for not acting quickly on a senior citizen’s complaint about a digital fraud in which she lost Rs 32 lakh. The court said that in cyber fraud cases, immediate action is necessary to prevent further loss and directed the police to improve their response system.
The Delhi High Court highlighted the need to discard outdated criminal laws in favor of newly enacted legislation, reinforcing Parliament’s intent. The court condemned reliance on old laws in new petitions, urging adherence to the updated legal framework established on July 1, 2024, to enhance justice effectiveness and align with modern societal needs.
Three new criminal laws, aimed at modernizing the justice system, replace colonial-era laws from today. They introduce provisions like Zero FIR, online police complaints, electronic summons, and mandatory crime scene videography. The Ministry of Home Affairs has initiated various measures for effective implementation, including technological upgrades, capacity building, publicity campaigns, inclusion in curriculum, and review meetings.
Today, On 28th June, The Ministry of Home Affairs issued SOP for filing Zero FIRs and e-FIRs under the BNSS framework to modernize crime reporting and make it more accessible. The guidelines aim to leverage technology, allowing victims to report crimes promptly and accurately. Zero FIR addresses jurisdictional challenges, ensuring swift initiation of investigations.
Today, On 26th June, President Droupadi Murmu emphasized prioritizing justice over punishment with the introduction of new criminal laws, aiming to expedite judicial proceedings. The Bharatiya Nyaya Sanhita 2023, Bharatiya Nagarik Suraksha Sanhita 2023, and Bharatiya Sakshya Adhiniyam 2023 will replace outdated British-era laws, aligning with Indian values and emphasizing comprehensive justice for all.
