MUMBAI: The Bombay High Court has dismissed the criminal case against famous singer Kailash Kher. He was accused of hurting religious sentiments through his song ‘Babam Bam’. The bench, consisting of Justices Bharati Dangre and Shyam C Chandak, emphasized the value of tolerance in a democratic society.
Chief Justice of India D Y Chandrachud stressed the judiciary’s duty to uphold constitutional values, cautioning against personal ideologies in judgments. He emphasized the importance of impartiality and humility, urging judges to prioritize constitutional morality. Chandrachud raised concerns about judges’ personal views influencing rulings on interfaith marriages and relationships, advocating for a constitutionally grounded approach.
Today (3rd May): The Supreme Court rejected a dowry-harassment case, emphasizing tolerance, adjustment, and respect as foundations of a strong marriage. It cautioned against magnifying trivial issues and stressed the detrimental effects of divorce on children. The court advised against mechanical application of Section 498A of the IPC in matrimonial disputes, urging a balanced and considered approach to such cases.
