The Delhi government today challenged the Centre’s decision to empower the Lieutenant Governor to appoint lawyers and determine their fees for representing the State. The Supreme Court sought responses from the Central government and the LG. The Delhi government argued that this undermines its autonomy and hampers its ability to advocate for the interests of Delhi’s electorate.
Day-3 | 9-Judge Bench- The Supreme Court clarified that the power to impose a tax on mineral rights lies with the states, not the Parliament, and emphasized the need to preserve this authority. The court is deliberating on whether the royalty collected by the Centre on mining leases qualifies as a tax. The hearing will resume on March 5.
The Supreme Court ruled against the State’s notion that providing compensation for land acquisition is an act of generosity, affirming citizens’ right to property. In response to a contempt case, the Court dismissed arguments that delay in compensation benefitted landowners, and left the option open for landowners to challenge the compensation award.
The Patna High Court issued a notice to Bihar regarding mismanagement and non-utilization of funds collected under the Health and Education cess since 2008. The court ordered a comprehensive affidavit on the collected and expended funds within four weeks. The PIL highlights underutilization, misallocation, and lack of transparency, seeking proper fund use and compliance with CAG recommendations.
