“We Can’t Compel Parliament to Introduce Laws”: SC Dismisses Plea on Exclusion of IPC Section 377 Provision in New BNS Law

Today, On 14th October, the Supreme Court dismissed a petition to include provisions for unnatural offenses in the new Bihar Special Armed Police law, previously addressed in IPC Section 377. The court stated such legislative matters fall under Parliament’s jurisdiction and emphasized it cannot compel lawmakers to create specific offenses.

Today, On 28th August, The Delhi High Court gave the Centre six months to address the exclusion of ‘unnatural offences’ from the Bharatiya Nyaya Sanhita (BNS), expressing concern over non-consensual acts no longer being punishable. The absence of equivalent provisions in the BNS to address such acts has faced criticism. The Court instructed the government to make a decision within six months.
