Supreme Court Clarifies ‘Preponderance of Probabilities’ in Motor Accident Compensation Cases

The court confirmed that negligence in motor accident cases is determined by “preponderance of probabilities,” dismissing ICICI Lombard’s appeal against the tribunal’s findings.

On Aug 26, a Goa court revoked bail for Amit Palekar, Aam Aadmi Party’s Goa chief, in the 2023 Banastarim accident case involving three deaths. The court ordered his immediate surrender. Palekar was accused of evidence tampering and providing a decoy driver to protect Paresh Sawardekar, who faces charges for causing the fatal accident.
