Supreme Court: Public Prosecutors Should be Appointed Based on Merit, Not Political Factors

NEW DELHI: The Supreme Court of India on wednesday, set aside the conviction of three men who were declared guilty by the Punjab & Haryana High Court almost 20 years after they were acquitted by the trial court in a murder case. A Supreme Court Bench comprising Justices JB Pardiwala and R Mahadevan expressed deep concerns about the standards of Public Prosecutors in High Courts. The Court criticized the way in which the Punjab & Haryana High Court overturned the acquittal based on the Public Prosecutor’s arguments.

The Supreme Court of India acknowledged the significant pressure on judges, leading to inevitable errors, during a ruling on adverse remarks made against a Delhi judicial officer. Despite a target to raise the judge-to-population ratio to 50 per million by 2024, it remains below 25, highlighting the burden on the judiciary.

The Supreme Court of India acknowledged that judges can make mistakes and emphasized the importance of correcting errors in past orders, even after a case is closed. This recognition arose while revisiting a previous decision involving Indiabulls Housing Finance, where the court had granted protection and stayed debt recovery and money laundering proceedings against the company and its officials.
