Today, On 31st October, The Supreme Court ruled that investigating agencies must not summon advocates representing the accused, stressing that “such summons could infringe fundamental rights of the accused” and violate statutory provisions protecting lawyer-client confidentiality under Section 132 and the new BNSS framework.
Mumbai: The Interactive Lawyers’ Association for Women held a discussion on the use and misuse of Section 498A of the Indian Penal Code (IPC), which was replaced with Section 85 of the Bhartiya Nyaya Sanhita (BNS) in 2023. The event took place on Friday at courtroom number 21 in the Mumbai High Court complex and was attended by female lawyers and law students.
The Bombay High Court emphasized the need to impose heavy costs on individuals wasting the time of investigative agencies and courts. The court’s observation came during a bail plea hearing for a man accused of rape, where the accused and victim had resolved their differences. The court expressed concern over unnecessary FIR registrations and court time wastage.
