Today(on 14th August), The Supreme Court of India dismissed a PIL filed by Shivam Mishra seeking definitions of terms in the Preamble of the Indian Constitution. Mishra argued that he did not understand terms like “fraternity” and would be adversely affected without clear definitions.
Supreme Court judge Justice B.V. Nagarathna criticized the overstepping of roles by governors in India and their inactivity, reflecting poorly on the constitutional position of the governor. She emphasized the importance of fraternity and advocated for a focus on federalism, fundamental rights, and principled governance to strengthen Indian constitutionalism. She is set to become the Chief Justice of India in September 2027.
Chief Justice of India D Y Chandrachud stressed the judiciary’s duty to uphold constitutional values, cautioning against personal ideologies in judgments. He emphasized the importance of impartiality and humility, urging judges to prioritize constitutional morality. Chandrachud raised concerns about judges’ personal views influencing rulings on interfaith marriages and relationships, advocating for a constitutionally grounded approach.
On 8th March: During the ‘Hamara Samvidhan Hamara Samman’ campaign, Chief Justice DY Chandrachud emphasized the need for mutual respect and fraternity to maintain equality and unity in the nation. He highlighted the importance of upholding values of justice, liberty, equality, and fraternity within the Constitution and urged for an inclusive and just society.
