The retailer failed to contest the claim, and evidence clearly established the sale of a counterfeit product. This ruling emphasizes the importance of prioritizing product authenticity and consumer rights in e-commerce.
The Consumer Disputes Redressal Commission fined Flipkart, OnePlus, and a retailer Rs 30,000 for selling a used phone as new. They were also ordered to refund the complainant and pay additional compensation for unfair trade practices and negligence. The Commission criticized their indifference towards customer grievances and instructed them to cease such practices.
