The Gauhati High Court dismissed a Regular Second Appeal, reaffirming that a Civil Judge (Junior Division) cannot dissolve a Muslim marriage or authenticate talaq. Only the District Judge can decide matrimonial disputes where no Family Court exists.
The Supreme Court granted a mutual consent divorce while praising the woman for voluntarily waiving alimony and all financial claims. The Bench remarked, “We appreciate this kind gesture, which is very rare nowadays,” acknowledging her fairness in the settlement.

Aarti, the estranged wife of Ravi Mohan, has sought Rs.40 lakh as monthly alimony. Meanwhile, Ravi Mohan has once again claimed in the Chennai Family Court that he has already granted her a divorce.
The Orissa High Court criticized husbands who deliberately remain idle to evade paying maintenance to their wives and children. The court emphasized that such actions must be condemned. In a previous ruling, the same judge had also disapproved of wives who stay unemployed solely to claim maintenance.
