Proprietorship Is Only a Trade Name, Not a Juristic Person , Can Be Sued but Cannot Sue: Supreme Court

The Supreme Court ruled that a proprietorship is only a trade name and not a juristic person with separate legal status, holding that while such a concern can be sued, it cannot itself initiate legal proceedings.

Today, On 3rd March, The Delhi High Court provided relief to NUJS regarding the award of a degree in its suspended Business Law course. A Bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela issued a notice to the concerned student, Kapil Mishra. The court also stayed contempt proceedings against the university’s Vice-Chancellor.
