India’s new Chief Justice, B.R. Gavai, has given many important judgments like on Article 370, electoral bonds, bulldozer actions, and women’s rights, strengthening the Constitution, protecting freedom, and promoting justice, equality, and independent courts.
Today, On 13th November, the Supreme Court condemned “bulldozer justice,” stating that legal actions should not imply guilt before a fair trial. It ruled demolishing properties of accused individuals is unlawful, emphasizing due process, accountability, and the protection of family homes from arbitrary state action, regardless of accusations or convictions.
Yesterday, On 14th October, the Supreme Court dismissed a new plea against the use of bulldozers for demolition, asserting the issue had been resolved. It also declined to consider compensation claims for affected individuals. Reserved judgments on bulldozer actions are anticipated, emphasizing legal guidelines and protections regardless of religion amidst growing concerns over “bulldozer justice.”
Today, On 1st October, the Supreme Court reaffirmed that no religious structure can obstruct public spaces, emphasizing India’s secular nature. It ruled that all encroachments must be removed, applying equally to all citizens. The court stated that unauthorized constructions violate public safety and must adhere to uniform laws, regardless of religious affiliation.
Today, On 12th September, The Supreme Court criticized the practice of demolishing properties as punishment, emphasizing that allegations of involvement in a crime do not justify such actions. It warned against undermining the rule of law and stressed the need for due legal process. The court issued a notice to the Gujarat government to respond and ruled against the demolition of a specific house.
Madhya Pradesh CM Mohan Yadav defended ‘bulldozer justice’ as per Constitutional principles, stating no one is above the law. Congress leader Priyanka Gandhi Vadra criticized the practice, advocating for judicial determination of guilt. The controversy stems from alleged anti-Islamic remarks, leading to violent protests and the subsequent demolition of Shahzad Ali’s house.
