On 5th March: The Supreme Court dismissed MakeMyTrip’s trademark infringement plea against Booking.com, citing the generic nature of the term “booking” in online travel services. MakeMyTrip alleged that Booking.com’s use of the term infringed upon its brand, but the court ruled in favor of Booking.com, emphasizing the importance of considering genericness in trademark disputes.
MakeMyTrip Today approached the Supreme Court, alleging infringement of its trademark through Google Ads displaying links to rival company Booking.com. MakeMyTrip claims this diverts customers and benefits Google financially. They challenge a previous ruling and question the court’s jurisdiction. The matter is set to be heard by the Supreme Court, led by Chief Justice DY Chandrachud.
