The Supreme Court Today (Oct 22) permitted activist Teesta Setalvad to travel between November 14 and November 24 to attend the International Documentary Film Festival in Amsterdam. Setalvad had received an invitation from the organisers to attend the festival in her capacity as producer of the documentary film Cycle Mahesh.

The Supreme Court Today (Oct 22) asked why it took 8 years for the rape survivor to lodge complaint against Malayalam cine actor Siddique. A Bench of Justices Bela M Trivedi and Satish Chandra Sharma made the observation while hearing the anticipatory bail plea filed by Siddique. The Bench was hearing a plea by Siddique against an order passed by the Kerala High Court on September 24 rejecting bail to him.

Two men accused of killing Ripudaman Singh Malik, a Sikh man acquitted in the tragic 1985 Air India Kanishka terrorist bombing case, have pleaded guilty to second-degree murder in a Canadian court, according to media reports. Tanner Fox and Jose Lopez entered the pleas in the British Columbia (BC) Supreme Court on Monday (Oct 21) on the eve of their trial for the killing of 75-year-old Malik, who was shot several times outside his family business on the morning of July 14, 2022.

The Supreme Court Yesterday (Oct 21) noted that the tendency of over implication is reflected in a large number of cases filed alleging offence under Section 498A IPC and asked the Courts to be cautious about the same. The Court acquitted a man accused under Section 498A IPC while noting that only because he is the husband of guilty sister in law cannot be a ground to hold him guilty under the said offence in the absence of any specific material. The Court was hearing a Criminal Appeal against the decision of the High Court which partly allowed appellant’s appeal whereunder his conviction under Section 498-A of the Indian Penal Code, 1860 was confirmed.

The Supreme Court Today (Oct 21) extended the tenure of former Delhi High Court judge Justice Jayant Nath as the interim chairperson of the Delhi Electricity Regulatory Commission (DERC) even after he attains the superannuation age of 65 years. In a bid to resolve the impasse between the AAP-led Delhi government and the office of Lieutenant Governor (LG), the top court, on its own, had appointed Justice Nath as the interim chairperson of the DERC on August 4, 2023.

The Delhi High Court Today (Oct 21) observed that nothing can be worse than calling a news agency a stooge of the government or an agent of an intelligence agency. Bench made the remark while hearing Wikipedia’s appeal against a single-judge’s order directing it to disclose the identity of users who have allegedly included defamatory statements on ANI’s Wiki page. The Court observed that ANI’s suit discloses very serious allegations of defamation.The Court also praised Wikipedia for serving the public and said it has been a huge service to mankind.

NCLAT Upholds Central Government Takeover of Delhi Gymkhana Club

The National Company Law Appellate Tribunal (NCLAT) Today (Oct 21) upheld the Central government’s takeover of the prestigious Delhi Gymkhana Club. A coram of NCLAT comprising Chairperson Justice (retd) Ashok Bhushan and Technical Member Arun Baroka dismissed appeals against an order of National Company Law Tribunal (NCLT) approving the takeover. In April 2022, the NCLT allowed the Centre to take over the affairs of the Delhi Gymkhana Club, appointing a 15-member committee to manage its affairs.

Sub Registrars cannot refuse to register a property transfer document merely because of non production of either the original parent document of the property or a non traceable certificate from the police if the parent document had been lost, the Madras High Court has held. Justices R. Subramanian and R. Sakthivel hold that even non traceable certificate from the police need not be submitted if the original document had been lost.

While Respondent candidates identified only “YOKE” as correct, SSC contested this, leading the Single Judge to rule that informal usages like “OKEY” should be excluded. The Division Bench upheld the Single Judge’s decision, stressing the court’s duty to correct demonstrably wrong answers to prevent injustice.
