The Supreme Court is expected to deliver judgments in at least four important cases this week – the last for Chief Justice of India (CJI) DY Chandrachud who is set to demit office on November 10. November 8 will be his last working day. Various Benches headed by him will be delivering judgments on the minority status of Aligarh Muslim University (AMU), validity of the Uttar Pradesh Board of Madarsa Education Act of 2004, the wealth redistribution issue and dispute over the ownership of Jet Airways.

The Allahabad High Court refused bail to a man accused of raping a 4-year-old girl while observing that in our country little girls are worshipped. The Court was hearing a Criminal Miscellaneous Bail Application filed by the Applicant seeking enlargement on bail in a Crime case registered under Sections 363, 376, 511 IPC and Section 9M, 9U/10 POCSO Act. The bench of Justice Shekhar Kumar Yadav observed, “In our country, little girls are worshiped. Rape is a heinous crime and this type of cases are increasing day by day in our society.”

In light of recent disruptions in the Ghaziabad District Court, the Uttar Pradesh Judicial Service Association (UPJSA) convened an emergency online meeting to discuss mounting concerns about abuse, threats, and vandalism by certain advocates toward judicial officers. The association expressed alarm over an incident in which a group of advocates allegedly pressured, verbally abused, and vandalized the courtroom of the District Judge, Ghaziabad, affecting judicial dignity and morale. The meeting attendees condemned the incident, stressing that such behavior undermines the impartiality and independence of the judiciary.

‘Terminate 30-Week Pregnancy’: HC Permits 11-Year-Old Sexual Assault Survivor

The Bombay High Court Today (Oct 31) permitted an 11-year-old sexual assault survivor to terminate her 30-week pregnancy. A vacation bench of Justices Sharmila Deshmukh and Jitendra Jain said the minor shall undergo the procedure for termination on Thursday itself at the state-run J J hospital here. The girl had moved HC through her father seeking permission to end the pregnancy.

Andhra Pradesh High Court: “Daughter’s Place in Parental Family Remains Intact Even After Marriage”

The Andhra Pradesh High Court highlighted that daughters remain a part of their parents’ family for life, whether or not they have married. A daughter’s marriage does not terminate her status as a member of her parents’ family, Justice K Manmadha Rao emphasised. The Court criticised a 1999 State policy that extended different treatment to sons and daughters when it came to compassionate appointments, depending on whether the daughter was married.

The Delhi High Court on Tuesday (Oct 29) ordered auctioning of the Fortis trademark in connection with the Rs 3,500 crore arbitral award passed in favour of Japanese pharma major Daiichi Sankyo and against the former Ranbaxy promoters. Justice Sachin Datta passed the order on an application filed by Daiichi Sankyo seeking the sale of the Fortis trademark, owned by RHC Healthcare Management Services Pvt Ltd which is one of the judgment debtors in the matter.

The Delhi High Court Today (Oct 28) agreed to list for October 29 a plea by BJP MLAs seeking a direction to the city government to send 12 CAG reports on liquor duty, pollution and finance to the lieutenant governor for placing those before the assembly. The petition was mentioned for listing by a senior counsel appearing for the petitioners before a bench headed by Chief Justice Manmohan. “Tomorrow,” the bench, also comprising Justice Tushar Rao Gedela, said.

Supreme Court judge Justice BV Nagarathna bemoaned that funds supplied by the Centre to States for compensatory afforestation were not being utilised by State governments. The judge highlighted that out of the total Rs 57,325 crores of compensatory afforestation funds received and transferred to States, nearly Rs 38,698 crores remained unutilised. She added that the judiciary must be alive to the legal questions bought about by climate change and must live up to the challenge by creative interpretation of laws.
