Supreme Court Grants Bail To 2 More Convicts In 1987 Hashimpura Massacre Case

The Supreme Court Today (Dec 20) granted bail to two more convicts in the case pertaining to the killing of 42 Muslim men from Uttar Pradesh’s Hashimpura in 1987. A Bench of Justices Abhay S Oka and Augustine George Masih said the two convicts have till date undergone an incarceration of over six years and thus are entitled to bail.

Supreme Court Grants Bail To 2 More Convicts In 1987 Hashimpura Massacre Case

NEW DELHI: The Supreme Court of India on Friday granted bail to two more convicts in the tragic 1987 case where 42 Muslim men were brutally killed in Hashimpura, Uttar Pradesh.

A bench of Justices Abhay S. Oka and Augustine George Masih noted that these two convicts have already spent more than six years in jail. This long incarceration made them eligible for bail according to the Court’s decision.

“Undergone an incarceration of over six years and thus are entitled to bail.”

Just a few weeks earlier, the Supreme Court had granted bail to 10 other convicts in the same case. They had been imprisoned since 2018 after the Delhi High Court overturned their earlier acquittal that year.

Among the convicts granted bail on Friday, one is reportedly 82 years old, as informed to the Court.

The horrific incident occurred on May 22, 1987, when personnel from the Uttar Pradesh Provincial Armed Constabulary (PAC) allegedly rounded up 42 Muslim men from Hashimpura in the Meerut district. The victims were loaded onto a truck, driven to a nearby canal, shot, and their bodies were dumped in the canal.

In March 2015, a trial court in Delhi acquitted the 16 PAC personnel involved in the case, citing a lack of sufficient evidence.

However, on October 31, 2018, a Delhi High Court bench comprising Justices S. Muralidhar and Vinod Goel overturned the trial court’s judgment.

The High Court found the accused guilty of the killings.

The appeals filed by the convicted individuals against the High Court’s decision are still under consideration by the Supreme Court.

This case remains a significant chapter in India’s legal history, representing the pursuit of justice for the victims of the 1987 massacre while balancing the legal rights of the accused.
