SIR Process Challenge| Supreme Court Flags Massive Filings As CJI Says ‘Week Declared Miscellaneous Due To Huge Spike In Cases’

Today, On 15th December, The Supreme Court addressed a brief mentioning in the SIR process challenge, highlighting a surge in filings that week. CJI Surya Kant noted, “Week declared miscellaneous due to huge spike in cases,” indicating potential delays before the matter can be heard.

The Supreme Court heard a brief mentioning in the SIR matter.

The matter heard by a Bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi. 

Senior Advocate Rakesh Dwivedi sought clarity on whether the hearing would proceed during the current week.

Raising concern over possible delays, he pointed out that the entire week had been declared miscellaneous, creating uncertainty for the parties involved.

Responding to the request, the Bench explained that “up to the last day, the week was treated as miscellaneous” because of an unexpected surge in urgent filings before the Court.

CJI remarked,

“Last day we declared it a miscellaneous week, considering the weather and huge spike in cases- 300-500 cases have been listed, we will see if we can hear after miscellaneous matters”

The Bench noted that around 385 matters were suddenly filed, making it practically impossible to declare the week as a regular hearing week.

Because of this heavy inflow, the Court indicated that the SIR matter may have to be taken up at a later stage, possibly after the miscellaneous list is cleared.

The Bench further clarified that miscellaneous matters already fixed for the day would now spill over to the following days, which would inevitably affect overall scheduling.

When Senior Advocate Dwivedi requested that the matter be accommodated in January, the Bench responded clearly, stating that “in any case, the hearing cannot conclude this week and January remained a realistic possibility.”

The Court also made it clear that “no conclusion is being drawn today,” adding that both sides had already conveyed the same position.

The Bench said it would take a final call on scheduling after completing the day’s court work. Assuring the parties, the Court stated that it would try to continue hearing the matter and that the cause list would be notified accordingly once a decision is taken.

The clarification brings temporary certainty to the parties, while indicating that the SIR hearing is likely to resume once the Court clears the current backlog of miscellaneous matters.
