SC Protects Ex- Noida Authority Chief Engineer Yadav Singh from Arrest in Rs.954 Crore Corruption Case

NEW DELHI: Today(on 16th May),The Supreme Court has granted protection to former Noida Authority chief engineer Yadav Singh from arrest by the Central Bureau of Investigation (CBI) in a corruption case. The case revolves around Singh’s alleged execution of 1,280 maintenance contracts worth Rs.954 crore in just eight days in December 2011.

The bench, consisting of Justices Hrishikesh Roy and Prasant Kumar Mishra, took cognizance of the matter after senior advocate NK Kaul, representing Singh, informed the court about the issuance of a bailable warrant against his client following the CBI’s filing of a supplementary charge sheet.

Singh’s lawyer pointed out that the Supreme Court had previously granted him bail after he spent over three years in custody in connection with the case. However, he expressed concerns about a possible fresh arrest due to the filing of the supplementary charge sheet.

Addressing the issue, the bench stated-

“No coercive measures shall be taken against the petitioner.”

-and issued a notice to the CBI regarding Singh’s new bail plea.

The court has scheduled the next hearing for four weeks from now.

It is noteworthy that the Supreme Court had granted bail to Yadav Singh on October 1, 2019. At that time, the court had stated-

“After hearing the arguments from both sides, we believe it is fitting to grant bail to the petitioner, with conditions set by the trial court. However, Solicitor General Tushar Mehta expressed concern that releasing the petitioner on bail might lead to tampering with evidence or witnesses. Therefore, the respondent is permitted to request cancellation of bail if such circumstances arise.”

These remarks were made in 2019 when Singh was granted bail.

In another related case, on October 25, 2019, the Supreme Court had granted bail to Yadav Singh in a separate money laundering case filed by the Enforcement Directorate (ED). The ED had imposed money laundering charges against Singh in 2015, based on an FIR filed by the CBI. The Income Tax department had previously conducted a raid in November 2014, which revealed that Singh’s assets were significantly disproportionate to his income. Consequently, he was suspended by the Uttar Pradesh government at that time.
