The Supreme Court criticized a man who claimed to be the father of two minor Russian girls found living with their mother in a cave near Gokarna, Karnataka.
The court questioned his actions during the time the children were residing in such conditions, stating that “the country has become a haven where anybody comes and stays.”
Nina Kutina, a Russian citizen, and her two daughters were discovered on July 11 in a cave located in the Ramatirtha Hills, where they had reportedly lived for nearly two months without valid documentation.
Subsequently, the Russian consulate provided emergency travel documents for Kutina and her daughters.
Following this, Dror Shlomo Goldstein, an Israeli national, approached the Karnataka High Court, asserting that he was the girls’ father and requesting that the court prevent their immediate deportation.
He had previously filed a police complaint at the Panaji police station in Goa after being unable to locate his children.
The Karnataka High Court dismissed his petition, allowing the Union government to facilitate the return of Kutina and her daughters to Russia. The court noted that Kutina expressed a desire to return to her home country as soon as possible.
Additionally, it remarked that Goldstein failed to provide a convincing explanation for why the family had been living in a cave.
This issue resurfaced in the Supreme Court during Goldstein’s challenge to the high court’s ruling.
A bench comprising Justice Surya Kant and Justice Joymalya Bagchi questioned Goldstein’s claim, asking,
“What is your right? Who are you?”
When Goldstein’s counsel stated that he was the father, Justice Kant responded,
“Please show us any official document that you are declared father… why should we not direct your deportation?”
Justice Bagchi characterized the case as “publicity litigation” and added, “What were you doing when your children were living in a cave?”
Justice Kant further inquired,
“What were you doing in Goa?”
Ultimately, the bench permitted Goldstein to withdraw his petition, with Justice Kant commenting,
“This country has become a haven… anybody comes and stays.”
Nina Kutina (40) and her two daughters, Preya (6) and Ama (4), were rescued by police from the Ramatirtha cave in Gokarna, Uttara Kannada district, on July 11. Kutina had been residing there despite her visa having expired.
