Supreme Court Grants Interim Bail to Man Who Threatened Local Commissioner with Gun During Faridabad Inspection

The Supreme Court ordered interim release of the accused after his surrender and apology, directing him to deposit Rs 1 lakh with the Delhi High Court Lawyers’ Welfare Fund. The Bench warned that failure to pay would lead to automatic cancellation of bail.

New Delhi: The Supreme Court on Wednesday took up a case involving a man accused of pointing a gun at a court-appointed local commissioner during a judicial inspection in Faridabad. The hearing was held before a Bench of Justices Surya Kant and Joymalya Bagchi.

During the proceedings, Senior Advocate Shadan Farasat appeared for the accused and told the Bench,

“I have surrendered on November 6 and have been in custody for six days. I have also submitted an unconditional apology.”

Justice Joymalya Bagchi responded,

“Your air gun should be seized under the Arms Act.”

To this, Farasat clarified,

“An air gun does not require a license, My Lord.”

After hearing the submissions, the Supreme Court noted that the petitioner had surrendered on November 6 and had been in custody since that date.

The Court also acknowledged his unconditional apology. Taking these factors into account, the Bench decided to issue a notice in the matter.

Exercising its extraordinary powers under Article 142 of the Constitution, the Supreme Court ordered the petitioner’s interim release on bail.

However, this relief came with a condition — the accused must deposit Rs 1 lakh as compensatory cost with the Delhi High Court Lawyers’ Welfare Fund within two weeks.

The Bench made it clear that the amount will not be treated as a fine under the Contempt of Courts Act, and warned that if the petitioner fails to deposit the said amount within the stipulated period, his interim bail will stand automatically cancelled.
