New Delhi: The Supreme Court of India strongly criticised a lawyer for filing a frivolous petition and warned him that if such behaviour continues, he may face serious consequences in the future.
The matter was heard by a Bench led by Justice Suryakant, who did not hold back in expressing his disapproval.
During the hearing, Justice Suryakant said to the lawyer,
“Abhi tumhare against aisa order karenge ki yaad rakhoge.”
This sharp remark came when the court realised that the petition filed by the lawyer was baseless and had wasted the court’s valuable time.
In response to the judge’s comment, the lawyer tried to defend himself and said,
“Ye mere gaainst hi order hai.”
Justice Suryakant, not convinced by the explanation, then asked,
“Kahan se li h tumne law ki degree?”
The lawyer replied by saying,
“Bihar Institute of Law se, AIBE bhi clear kiya h.”
Reacting to this, Indicating his concern about the quality of legal education and the standard of petitions being filed in the Supreme Court, Justice Suryakant said,
“Haan Bihar se li h, BCI ka kya…”
In its official order, the Supreme Court observed that such frivolous petitions should attract exemplary costs so that this kind of misuse of legal process can be discouraged.
However, the Bench decided not to impose any cost this time.
The order clearly stated,
“Not putting any cost for now, but if this is repeated cost will be imposed.”
This strong warning by the top court highlights the growing frustration of the judiciary over the increasing number of meaningless and badly drafted petitions being filed by some advocates.
The court’s remarks also show how seriously it is taking the matter of maintaining judicial discipline and respect for the court’s time.
The Supreme Court has once again made it clear that it will not tolerate any misuse of the legal process and that anyone who files careless or non-serious petitions will have to face strict consequences in future.
