New Delhi: The Supreme Court granted interim protection from arrest to MLA M. Jagan Moorthy, who is facing potential arrest in a case involving the alleged kidnapping of a boy.
Moorthy, known as “Poovai” Jagan Moorthy, serves as the president of the Puratchi Bharatham party, an ally of the main opposition party, AIADMK, and represents the K V Kuppam assembly constituency.
A bench comprising Justices Manoj Misra and N. Kotiswar Singh issued a notice to the Tamil Nadu Police concerning the appeal filed by the MLA.
The bench stated,
“If the petitioner is arrested in connection with FIR registered at PS- Thiruvalangadu, he shall be released on personal bond of Rs 25,000 subject to the undertaking that he shall cooperate in the investigation and will not threaten the witnesses or tamper the evidence,”
The court was addressing Moorthy’s appeal, which challenged the Madras High Court’s June 27 ruling that denied his request for anticipatory bail.
He contended that he was being framed based on a co-accused’s confession, arguing there was no direct or corroborative evidence linking him to the alleged crime. Moorthy maintained that the case was politically motivated and aimed at damaging his reputation.
The high court had dismissed his plea, indicating that there was “prima material” to proceed against him. The case involves the elder brother of the abducted boy, who married outside his caste against the wishes of his family.
The prosecution alleged that the boy’s mother claimed that the bride’s father conspired with Moorthy and Additional Director-General of Police (ADGP) H.M. Jayaram to track down the couple.
According to the FIR, a gang kidnapped the complainant’s younger son from their home in the early hours of June 7.
However, after the police intensified their search following the complaint, the boy was reportedly dropped near the Perambakkam bus stand within hours of his abduction in the official vehicle of the ADGP to evade police detection, according to the prosecution.
