The Supreme Court will hear next week a plea challenging the appointment of Anurag Gupta as Jharkhand DGP. The CJI said the matter will be “listed before a three-judge Bench” due to its importance.

The dispute over appointing IPS officer Anurag Gupta as the Jharkhand DGP has now reached the Supreme Court.
This morning, the matter was brought before a Bench led by Chief Justice of India BR Gavai and Justice Vinod Chandran, who stated that a three-judge Bench will hear the case.

Senior Advocate Anjana Prakash noted,
“DGP in Jharkhand is continuing despite the process of DGP appointment.”
The Chief Justice inquired,
“Whom are you appearing for?”
Prakash responded,
“I am appearing for a social activist who is against the appointment,”
The CJI confirmed,
“We will have it listed before a three-judge Bench,”
Reports indicate that Gupta was scheduled to retire on April 30 this year under the Central government’s rules upon reaching 60 years of age. Nevertheless, the State government sought to extend his tenure.
The State’s Home Ministry has reportedly asserted that Gupta was appointed DGP on February 2, 2025, under the newly notified Jharkhand DGP and IG Selection and Appointment Rules, 2025 (which were notified on January 8, 2025).
The Union Home Ministry, On April 22, 2025, sent a letter to Jharkhand Chief Minister Hemant Soren, indicating that Gupta’s tenure could not be extended beyond his scheduled retirement.
Despite this, the State government retained Gupta as the Jharkhand DGP and has recently issued him a “provisional pay slip,” amid the ongoing dispute between the Centre and the State.

This situation has now been challenged in the Supreme Court by several social activists.
Additionally, a related case is pending before the Jharkhand High Court.
Reports also indicate that BJP Member of the Legislative Assembly (MLA) and Leader of the Opposition in Jharkhand, Babulal Marandi, has filed a petition contesting the legality of DGP Gupta’s appointment and the extension of his tenure.
