NEW DELHI: The Supreme Court today(on 12th July), declined to entertain a Public Interest Litigation (PIL) seeking an investigation into the Hathras stampede that resulted in 121 deaths, directing the petitioner to approach the Allahabad High Court instead.
The bench, which included Chief Justice D Y Chandrachud and Justices JB Pardiwala and Manoj Misra, acknowledged the gravity of the incident but emphasized that high courts are well-equipped to handle such cases.
“Indeed, these incidents are troubling. Filing a PIL here often amplifies such matters. The high court is competent to handle this case. Therefore, the petition is dismissed.”

The Court instructed lawyer and petitioner Vishal Tiwari to move the Allahabad High Court and disposed of the PIL.
Tiwari argued that the issue of inadequate medical facilities to manage such incidents is a nationwide concern and that the Supreme Court could also address the PIL. However, the Chief Justice rejected this submission.
The plea sought the formation of a five-member expert committee, under the supervision of a retired Supreme Court judge, to investigate the stampede that occurred on July 2. The incident took place during a religious gathering in Uttar Pradesh’s Hathras district. Over 2.5 lakh devotees had convened in Phulrai village for a ‘satsang’ led by Baba Narayan Hari, also known as Saakar Vishwahari and Bhole Baba.
In response to the incident, the Uttar Pradesh Police registered an FIR against the event organizers, accusing them of concealing evidence and violating conditions, as the gathering vastly exceeded the permitted limit of 80,000 people.
