New Delhi: Today, on June 17, the Supreme Court of India has ordered that no demolition should take place for the next one week at a religious shrine (dargah) located in Thane, Maharashtra.

The order comes as temporary relief for the trust managing the dargah, which had challenged a demolition order issued by the Bombay High Court in March.

A bench of Justices Sandeep Mehta and Prasanna B Varale passed the interim direction while hearing a plea filed by the trust that oversees the shrine.

The plea sought protection against the high court’s March 10 order which had directed the authorities to remove unauthorised portions of the dargah.

During the hearing on Tuesday, the Supreme Court clearly stated that there should be no action taken against the structure for the next seven days.

The bench observed that this short relief would give the trust an opportunity to approach the Bombay High Court and request it to reconsider the demolition order.

The court said,

“Status quo to be maintained for a period of seven days.” It further directed, “The petitioner shall, in the meantime, move an application before the high court for recall/modification of the order dated March 10.”

This means that the trust must now file an application before the Bombay High Court, asking it to either take back or modify its earlier decision to demolish parts of the dargah which were deemed unauthorised.

The Supreme Court’s interim stay is not a final ruling but a temporary pause to allow the trust to explore its legal options in the high court.

The March 10 order of the Bombay High Court, which is currently under challenge, had directed the demolition of portions of the dargah that were allegedly built without proper permission or in violation of regulations.
