Plea Against Ex-CJI Ranjan Gogoi|| “Call Security. One More Word & You’re Out”: SC Warns Advocate

Today, On 15th October, During a heated exchange in a plea against former Chief Justice of India Ranjan Gogoi, the Supreme Court called for additional security. The plea sought an in-house inquiry into Gogoi’s dismissal of a petition concerning a service dispute. However, the Court declined to entertain the request. The tense proceedings highlighted the sensitivity surrounding the case.

New Delhi: Today, a heated exchange unfolded in the Supreme Court between the Bench and an advocate who sought an inquiry against former Chief Justice of India, Ranjan Gogoi.

The Bench, comprising Justices Bela M. Trivedi and Satish Chandra Sharma, declined to entertain the plea. The Court ultimately ordered security to escort the petitioner, Arun Ramchandra Hublikar, out of the courtroom, expressing frustration with the repeated applications.

The Court before dismissing the plea remarked,

“We are going to put an end to this. So many applications, one after the other,”

Arun Ramchandra Hublikar filed a plea seeking an in-house inquiry against former Chief Justice of India, Ranjan Gogoi, who had since retired. Hublikar claimed that Justice Gogoi unjustly interfered in a judgment regarding his service dispute, leading to his unlawful termination.

He submitted before the Court,

“I completed my LLB and LLM. Justice Gogoi unwarrantedly interfered in a judgment, making my life miserable by interfering in an order passed in my favour.”

However, the Bench, led by Justices Bela M. Trivedi and Satish Chandra Sharma, was not inclined to accept the plea.

The Court firmly responded,

“We are going to impose costs. Don’t take any name of the judge. There is nothing in your case.”

Hublikar, visibly upset, responded to the Court’s dismissal of his plea by saying,

“Nothing? How can it be said? It is injustice against me. At least I should get justice before my death.”

Despite his protest, the Court remained firm in its decision.

The Bench declared,

“Sorry, we cannot interfere. All your petitions are dismissed,”

Angered by the response, Hublikar retorted,

“How can you say sorry? This Court has made my life miserable.”

At this point, Justice Trivedi instructed security to escort him out, warning,

“Call security. Don’t compel us to take action against you. If you speak a single word, you are out.”

Even as security was called, Hublikar continued to protest, saying,

“Madam, you are doing injustice against me. What is the problem in issuing notice against the complainant?”

The Bench then reiterated,

“Security, please take him out. We are calling security.”

During the heated exchange, Senior Advocate Siddharth Luthra, present in the courtroom, attempted to calm Hublikar by explaining that his case had already been dismissed.

As Hublikar was escorted out of the courtroom by security, he was heard questioning Senior Advocate Siddharth Luthra, saying,

“Kyun dismiss kiya inhune, aise kaise kar sakti hai ye (Why did they dismiss, how can she do this)?”

Despite his protests, security took him out of the courtroom.

This was not Hublikar’s first contentious appearance in the Supreme Court. Last month, he had faced criticism from another Bench when Chief Justice D.Y. Chandrachud questioned his filing of a PIL that named a judge as a respondent.

Referring to Hublikar’s inclusion of former Chief Justice Ranjan Gogoi, who currently serves as a Rajya Sabha member after retiring from the Supreme Court in November 2019 the CJI had asked,

“How can you file a PIL with a judge as a respondent?”
