Supreme Court Dismisses Student’s Plea Over Age Bar in JNUSU Elections: Rules Are Rules!

The Supreme Court rejected a student’s plea against her nomination rejection for JNUSU polls. The bench upheld the age limit rule barring candidates above 25.

New Delhi, April 23: The Supreme Court of India has dismissed a petition filed by a student who challenged the rejection of her nomination for contesting in the Jawaharlal Nehru University Students’ Union (JNUSU) elections, which are scheduled to be held on April 25.

A bench of the Supreme Court, consisting of Justice Vikram Nath and Justice Sandeep Mehta, heard the plea and decided not to interfere with the existing rule that disqualifies students above the age of 25 years from contesting in the JNUSU elections. The bench made it clear that they did not find any valid reason to overturn this regulation.

The student, who had submitted her nomination to stand in the student union elections, approached the apex court after her application was rejected on the basis of the age limit set under the election rules. According to the regulation,

any candidate who is older than 25 years is not eligible to contest in the JNUSU polls.

The bench initially advised the student’s legal counsel to approach the Delhi High Court for relief. However, after briefly considering the matter themselves, the judges decided to hear the plea. Despite hearing the arguments presented by the student’s side, the Supreme Court ultimately rejected the petition and maintained the decision made by the election authorities.

The judges said,

they did not wish to “interfere with the regulation” which was clear in its terms and had been applied appropriately.

This decision highlights the importance of complying with established rules in student elections and shows the judiciary’s unwillingness to entertain exceptions that are not supported by legal grounds.

This legal development is important for all those participating in the JNUSU elections, as it reinforces the eligibility criteria laid down under the regulations, especially concerning the age limit.
