NEW DELHI: The Supreme Court of India advised Hyderabad-based businessman Arun Ramachandra Pillai to approach the Delhi High Court for interim bail in a money laundering case related to the Delhi excise policy.
This directive came from a bench comprising Justices Abhay S. Oka and Satish Chandra Sharma, who instructed Pillai to file his plea with the High Court and to include all relevant medical documents to support his request for bail on medical grounds.
Pillai had approached the Supreme Court challenging a Delhi High Court order that had postponed the hearing of his interim and regular bail pleas until July. He had been arrested on March 6, 2023, and has been in custody since then, with a brief period of release from December 18, 2023, to January 24, 2024, when he was granted interim bail to care for his wife.
In his plea, Pillai explained that his medical condition had deteriorated during his time in custody. He detailed suffering from severe lower back pain, which had significantly impacted his daily life and routine activities. Pillai expressed concerns about the risk of permanent damage to his back due to inadequate medical treatment in jail.
He had informed the jail doctor about his condition, which included severe back pain and restricted mobility. The jail authorities referred him to external outpatient departments (OPDs) for further medical evaluation and treatment. Despite these referrals, Pillai’s condition reportedly did not improve, prompting his plea for interim bail on medical grounds.
During the hearing, Pillai’s legal counsel argued that his health issues required immediate and specialized medical attention that was not available within the jail’s facilities. The counsel emphasized the necessity of interim bail to ensure Pillai could receive the appropriate medical treatment to prevent permanent damage to his health.
The Supreme Court’s directive provides Pillai a renewed opportunity to seek interim bail by presenting his case before the Delhi High Court. He is expected to substantiate his plea with comprehensive medical documentation to demonstrate the severity of his condition and the urgent need for medical care outside the jail.
This case highlights the broader issue of medical care availability for inmates and the judiciary’s role in ensuring that detainees’ health needs are adequately addressed. The Supreme Court’s guidance underscores the importance of addressing legitimate medical concerns within the justice system and ensuring that individuals in custody receive the necessary medical attention to safeguard their health and well-being.
