The move comes as a response to the recent decision that revoked his candidacy, adding to the political tension in the region. Dhar’s legal challenge underscores the high stakes and legal complexities surrounding electoral processes in India, especially during crucial political contests.

New Delhi: Debasish Dhar, the Bharatiya Janata Party (BJP) candidate for the Birbhum Lok Sabha constituency, approached the Supreme Court seeking to overturn the cancellation of his nomination papers. Represented by senior advocate Nidhesh Gupta, Dhar’s plea presented before a bench headed by Chief Justice of India, DY Chandrachud. Gupta emphasized the urgency of the matter, noting that the deadline for nomination submissions imminent.
When the senior lawyer emphasized that the plea required immediate hearing today itself. Chief Justice of India stated,
“I will see the email (seeking urgent listing),”
Highlighting the time-sensitive nature of the case, Gupta stated,
“The plea for an urgent hearing is critical as today marks the final opportunity for filing nominations,”

This move by Dhar part of a broader context of political candidates challenging administrative decisions that they believe unjustly hinder their political careers and the democratic process at large.
Birbhum a significant Lok Sabha constituency in West Bengal, India. This region known for its political volatility and has been a stronghold of the ruling party, the Trinamool Congress (TMC). Birbhum has a history of intense political competition and election-related violence. The Bharatiya Janata Party (BJP), which is the primary opposition party in West Bengal, nominated a candidate for the Birbhum Lok Sabha seat. The identity and political background of the nominee might be relevant, but specific details such as their name and political history haven’t been disclosed here.
At some point during the electoral process, the nomination of the BJP candidate cancelled. The reasons for the cancellation are critical to the story but are not specified in the brief. Typically, nomination cancellations could be due to improper or incomplete documentation, failure to meet eligibility criteria, or other legal and administrative reasons. The appeal to the Supreme Court suggests that earlier remedies at lower courts or electoral tribunals might either have been exhausted or bypassed in favour of a direct appeal to the highest judicial authority in the country.
