New Delhi: The Supreme Court prohibited the declaration of the Bihar legislative council by-election results for the seat formerly held by expelled RJD leader Sunil Kumar Singh. Singh was expelled from the Bihar legislative council on July 26 of last year due to uncivilized behavior in the House.
Singh, who is considered close to RJD supremo Lalu Prasad and his family, faced charges for sloganeering against Chief Minister Nitish Kumar during a heated exchange in the House on February 13, 2024.
A bench of Justices Surya Kant and N. Kotiswar Singh was informed by Senior Advocate Abhishek Manu Singhvi, representing Singh, that the by-election results were expected to be announced on January 16, as the election was unopposed.
The bench noted that since it was already hearing arguments on the matter, the results for the seat should not be declared in the meantime.
Singhvi pointed out that the court had been considering his plea against the expulsion since August 2024, and if the court were to rule in his favor, it would create a peculiar situation with two candidates vying for the same seat.
The bench scheduled to hear the responses from the state legislative council, ethics committee, and others on January 16, after which it would reserve its judgment on the issue.
In 2024, a motion for Singh’s expulsion was passed by voice vote, following a report from the ethics committee submitted to acting chairman Awadhesh Narain Singh.
Singh was also accused of “insulting the chief minister by mimicking his body language” and questioning the competence of the ethics committee members after appearing before them. Alongside Singh’s expulsion, another RJD MLC, Mohd Qari Sohaib, was suspended for two days for disruptive behavior on the same occasion. The ethics committee’s report indicated that while Sohaib expressed remorse during the inquiry, Singh remained defiant.
