AI-Generated Fake Judgments Becoming a Global Menace: Supreme Court

The Supreme Court of India warned against fabricated AI-generated judgments being cited in courts, calling it a growing menace globally. The bench of Rajesh Bindal and Vijay Bishnoi urged caution while relying on such material.

NEW DELHI: The Supreme Court voiced concern about the rising “menace” of lawyers and litigants citing fabricated judgments produced by artificial intelligence, warning that the practice is becoming more widespread in courts.

A bench of Justices Rajesh Bindal and Vijay Bishnoi observed that such occurrences are not confined to India but are being witnessed globally, and urged greater caution when relying on AI‑generated material.

The remarks were made as the apex court expunged certain observations by the Bombay High Court in a matter involving a company director.

Adding that the issue is already under consideration on the judicial side, the bench said,

“As a matter of indulgence, we expunge the remarks … However, the fact remains that this menace is rampant in all courts now, not only in India but throughout the world. Everyone needs to be careful about this,”

The high court had noted that written submissions appeared to be produced using AI tools such as ChatGPT, pointing to formatting clues and repetitive language as indicators. It also cited a referenced case that could not be located in legal records.

Despite searches by the court and its law clerks, the cited judgment remained untraceable, which the high court said resulted in a waste of “precious judicial time”.

The high court emphasized that, although AI tools can aid legal research, parties are responsible for verifying the accuracy and authenticity of material generated through such technologies.
