Sameer Wankhede’s Sister Challenges Police Clean Chit to Nawab Malik in Defamation Case

Yasmeen Wankhede has opposed the police report clearing Nawab Malik in her defamation case, alleging the investigation was biased and “influenced.”

Senior IRS officer and former NCB zonal director Sameer Wankhede’s sister, advocate Yasmeen Wankhede, has raised strong objections against the police investigation into her defamation complaint against senior NCP leader and former Maharashtra minister Nawab Malik.

She alleged that police authorities failed to conduct the probe “without any unbiasedness” and claimed that the investigation appeared to have been “influenced and, even to some extent, directed” by Mr. Malik.

The case dates back to 2021, when Yasmeen Wankhede filed a complaint before the Bandra magistrate court. She accused Mr. Malik of making false, defamatory, and scandalous statements against her through a series of tweets and television interviews.

Taking note of her complaint, the magistrate had ordered an inquiry under Section 202 of the Code of Criminal Procedure (CrPC) and directed the police to submit a report.

In response, the police filed a report before the court giving Mr. Malik a clean chit. The report said that prima facie, there was no evidence of a cognizable or even a non-cognizable offence against him.

The police also recorded Mr. Malik’s defence, where he maintained that his statements and press conferences were made in his official capacity. According to the report, Mr. Malik stated that his posts and press interactions at the time were part of his role as the spokesperson of a political party.

He also added that

“he has no personal animosity towards Yasmeen Wankhede.”

Disagreeing with this report, Yasmeen Wankhede, through her advocate Ali Kaasif Khan, filed a protest petition before the court.

In her petition, she argued that the police findings

“attempts to justify the conduct of the accused person, which is contrary to the provisions of law.”

The petition reiterated that

“police authorities have failed to investigate the matter without any unbiasedness.”

It further alleged that “appropriate actions were not taken by the authorities” even though “clear defamatory words” had been used against Yasmeen Wankhede, who herself is a practicing advocate.

On the specific claim made by Mr. Malik that he was acting as a political spokesperson, the advocate pointed out that

“it does not authorise the accused to misuse private photographs from Instagram and publish them publicly for his own private agenda.”

The court has fixed the next hearing of the matter for September 22.

The complaint also recalled the background of the dispute, noting that during his tenure as Zonal Director of the Narcotics Control Bureau (NCB), Sameer Wankhede had led several high-profile drug busts and handled sensitive NDPS cases.

One of those cases involved Nawab Malik’s late son-in-law, Sameer Khan. According to Yasmeen,

“out of vengeance and personal grudge held against the complainant’s brother for taking legal action against his son-in-law, the accused (Malik), as a countermeasure and counterblast, started making false, defamatory and baseless allegations against the complainant and her family members.”
