The case was filed by Pankaj Pathak, a divisional president of the Akhil Bharatiya Hindu Mahasabha and a local resident. Represented by his lawyers, Gupta and Anil Dwivedi, Pathak had sought to file an FIR against Gandhi in the MP-MLA Court.

Bareilly (UP): Leader of Opposition in the Lok Sabha, Rahul Gandhi, was scheduled to appear before a district court in Bareilly on Tuesday (7th Jan) regarding a case linked to his remarks on economic reservation. However, he did not attend the hearing.
The court granted him time to appear for the next hearing on January 17, as per the petitioner’s lawyer, Virendra Pal Gupta.
Gupta stated, “Rahul Gandhi was expected to present his case before District and Sessions Judge Sudhir Kumar today, but he was absent. The court has now transferred the case to the MP-MLA Court and allowed him time until January 17 to appear.”
Previously, District and Sessions Judge Sudhir Kumar issued the summons on 22nd Dec in response to a plea filed by Pankaj Pathak, Mandal president of the All India Hindu Mahasangh.
Pathak had initially approached the MLA-MP Court/CJM Court in August, seeking the registration of a case against Gandhi. However, his application was rejected on August 27. He subsequently filed a revision petition in the sessions court, resulting in the issuance of the summons.
Advocate Virendra Pal Gupta, representing Pathak, claimed that Gandhi had remarked during the elections that “despite the percentage of weaker sections being high, the percentage of property they own is quite low. If this remains the case, then those with a higher population can demand more property.”
Gupta alleged that these statements were intended to provoke economically weaker sections and “create class hatred for political gain.”

However, the court dismissed the petition on August 27, 2024. A review petition challenging this dismissal was later filed in the Sessions Court.
District and Sessions Judge Sudhir Kumar accepted the criminal revision petition and scheduled the hearing for Tuesday.
Pathak alleged that Gandhi’s remarks sought to appease one community while targeting another’s property, causing deep offense. He expressed confidence that the court would uphold public sentiment and take appropriate action.
