The Juvenile Justice Board (JJB) in Pune granted bail to the minor. The bail conditions included the submission of a 300-word essay on road accidents after studying traffic rules and regulations at the Regional Transport Office (RTO). The Board also directed the minor’s parents to ensure he stays away from such offenses in the future and is kept away from bad influences.

Pune: In the Porsche car accident case, a Pune court has sent father and four individuals to police custody until May 24. The incident, which resulted in the tragic deaths of two software engineers, has sparked widespread outrage and brought to light issues of underage drinking and negligent driving.

The Police have arrested Naman Bhutada, owner of Cosie Hotel, bar counter manager Sachin Katkar, and Blak club manager Sachin Sangle. These individuals are accused of serving alcohol to a juvenile, who later caused the fatal accident. The father of the juvenile has also been arrested, although he has yet to be presented in court for custody.

On Sunday, a 17-year-old, the son of a prominent builder in Pune, was driving a Porsche when he collided with a motorcycle in the Kalyani Nagar area. The crash claimed the lives of two people. It was revealed that the minor had been drinking at a pub with friends before the incident occurred.

The minor driver faces multiple charges under the Indian Penal Code (IPC) and the Maharashtra Motor Vehicles Act. The charges include:

Given the severity of the case, the juvenile is likely to be tried as an adult.

“The father of the teenage boy was arrested on Tuesday evening, hours after he was detained from Maharashtra’s Chhatrapati Sambhajinagar,” stated Amitesh Kumar, Commissioner of Police.

Additionally, the juvenile’s father and the bar face charges under Sections 75 and 77 of the Juvenile Justice Act, as stated by the Pune city police.

As the horrific crash caused a nationwide outrage, Maharashtra Deputy Chief Minister Devendra Fadnavis, He stated that the Juvenile Justice Board (JJB) took a “lenient view” on the remand report filed by the police and granted bail to the boy on the condition that he perform community service for 15 days and write a 300-word essay on road safety.

“The order granting bail by the JJB was shocking and surprising, exacerbating the public outrage,” remarked the deputy CM.

The police filed an application in a higher court challenging the JJB’s decision.

“However, the court instructed the police to approach the Board again and file a petition for revision of the order. The court also stated that if the JJB does not review its order, the police can then approach the higher court,” he explained.

Fadnavis mentioned that the police have approached the JJB for a revision of its order, with a decision expected by Wednesday.

He assured that the police would do everything necessary to ensure justice in this case.

“The police are taking this case very seriously and will not tolerate someone receiving bail after fatally injuring two people,” Fadnavis asserted.

Concerns have been raised about pubs and restaurants with lax age verification practices, he noted.

“The police have been instructed to enforce the rules for liquor-serving establishments strictly. Additionally, measures are being implemented to curb drunk driving,” said Fadnavis.

Background

The car, a Porsche, allegedly driven by the boy who police claim was intoxicated at the time of the accident, fatally struck two motorbike-riding IT engineers in Kalyani Nagar early Sunday morning. The Juvenile Justice Board granted the minor bail just hours after the crash.

The police station registered a case against the juvenile driver under relevant sections of the Indian Penal Code and Motor Vehicles Act, including charges of rash driving and causing death by negligence.

The police have charged the minor with rash and negligent driving and causing harm by endangering life or personal safety under IPC Sections 304A, 279, 337, 338, and 427, along with relevant sections of the Maharashtra Motor Vehicle Act.

Additionally, Pune City Commissioner of Police Amitesh Kumar announced that cases would be filed against the driver’s father and the establishment that served the young driver alcohol.

The juvenile court, after considering the circumstances of the case, granted bail to the minor driver. Although the details of the bail hearing were not publicly disclosed, police officials stated that the court did not deem the crime “serious” enough to deny bail. However, the court imposed several conditions on the teenager’s release, aiming to address the gravity of the offense and provide an opportunity for rehabilitation and behavioral correction.
