Mumbai 2015 Drink & Drive Accident: Police Seeks ‘Murder Charges’ Against Lawyer

Public prosecutor Iqbal Solkar argued that, as a lawyer, Gadkar was fully aware of the legal repercussions of driving under the influence of alcohol but chose to do so regardless.

Mumbai: The Mumbai Police have approached a Maharashtra court seeking to add murder charges against corporate lawyer Jhanvi Gadkar in connection with the 2015 hit-and-run case that claimed two lives.

Public prosecutor Iqbal Solkar argued that, as a lawyer, Gadkar was fully aware of the legal repercussions of driving under the influence of alcohol but chose to do so regardless.

On June 10, 2015, Gadkar drove her Audi Q3 into a taxi, resulting in the deaths of two individuals, Mohammed Abdul Sayyad (55) and Mohammed Salim Sabuwala (50). Following the accident, the Mumbai Police filed a case against her under relevant sections of the Indian Penal Code.

In hit-and-run cases, the police framed charges under Sections 279, 337, 338, and 304A of the Indian Penal Code.

During the proceedings, Solkar, representing the Mumbai Police, argued that the charges against Gadkar should be elevated due to her professional background as a lawyer, which implied that she knew the dangers of drinking and driving.

Despite this knowledge, Gadkar consumed alcohol at three different locations and subsequently drove on the wrong side of the Eastern Express Highway. Solkar contended that her actions suggested an intent to kill, or at least a reckless disregard for life. He described how Gadkar took a U-turn, drove two kilometers on the wrong side of the highway, and then crashed into the taxi in a rash and negligent manner.

After the prosecution’s arguments, Gadkar’s lawyers requested additional time to respond regarding the applicability of the murder charges. The hearing has been adjourned to October 1.
