The Special MP-MLA Court in Lucknow dismissed a petition seeking an FIR against Rahul Gandhi over alleged British citizenship. The court ruled that it has no jurisdiction to decide citizenship matters and termed the plea an abuse of legal process.

The Special MP-MLA Court in Lucknow has dismissed a petition filed against Leader of the Opposition in the Lok Sabha and Congress MP Rahul Gandhi, which alleged that he holds British citizenship.
The order was passed by Special Judge III (ACJM) Alok Verma after the matter was heard continuously for eight days. While rejecting the plea, the court clearly observed that the petition was an “abuse of process of law” and further stated that the court has
“no jurisdiction to decide on the nationality or citizenship of any person.”

The case arose from a petition filed by BJP member S. Vignesh Shishir, who sought directions for registration of an FIR against Rahul Gandhi by alleging serious violations linked to British citizenship.
The petitioner requested action under multiple provisions of the Indian Penal Code, along with the Official Secrets Act, 1923, the Passport Act, 1967, and the Foreigners Act, 1946, claiming that grave legal offences had been committed.
The Special MP-MLA Court conducted the hearing on a day-to-day basis for the past eight days. During this period, the petitioner himself argued the case and made submissions for more than 20 hours. The court was taken through several important judgments of the Supreme Court, relevant legal precedents, and documentary material relied upon by the petitioner.
In total, 45 annexures were filed before the court, along with a sealed envelope and a lengthy 310-page plaint. All these materials were formally taken on record and carefully examined by the court before arriving at its final decision.

The petition specifically sought an order directing registration of an FIR against Rahul Gandhi, alleging offences under various penal laws and special statutes. The petitioner maintained that the alleged facts disclosed serious legal violations requiring criminal investigation.
According to the petitioner, following an order of the Supreme Court, the matter was initially being heard by the MP-MLA Court in Rae Bareli. However, citing threats to his life, he requested that the proceedings be shifted to Lucknow so that the case could be heard impartially.

Acting on this request, the Lucknow Bench of the Allahabad High Court directed that the entire matter be transferred to the Special MP-MLA Court in Lucknow. Pursuant to this order, the case was moved from Rae Bareli to Lucknow, where detailed arguments were heard over several days before the court finally dismissed the petition.
The dismissal brings an end to the proceedings in the alleged British citizenship case, with the court firmly holding that it could not entertain the petition or order criminal action on matters relating to citizenship.
