Lawyer Sues Gucci in Consumer Court Over Defective Shoes: “Luxury Brand Caused Injury, Mental Trauma”

A lawyer has filed a consumer court case against Gucci, alleging that defective shoes caused him to slip and suffer injuries. He claims the luxury brand caused physical harm, mental trauma, and failed in customer service.

Mumbai: The South Mumbai District Consumer Disputes Redressal Commission has issued a notice to luxury fashion brand Gucci following a complaint from Mumbai-based advocate Ali Kaashif Khan Deshmukh.

He claims that a defective pair of Gucci shoes led to a public fall and visible distress shortly after he purchased them.

The notice was issued on Friday by a bench that included Commission President Sadik Ali B Sayyad and Member Gauri M Kapse.

It has been served to Guccio Gucci S.p.A. (Italy) and Gucci’s Mumbai locations at the Trident Hotel and Jio World Plaza. The complaint originates from an incident on March 6, 2024, when Deshmukh bought a pair of Gucci shoes for R.75,500.

He alleges that within an hour of the purchase, he experienced discomfort due to uneven elevation between the shoes, which caused him to stumble and fall in public.

Deshmukh reports that when he returned to the store the same day, he was redirected and treated dismissively by the staff at Gucci’s Bandra Kurla Complex outlet. A written acknowledgment dated March 7, 2024, from Gucci purportedly confirmed a slight elevation difference after an internal inspection of the shoes.

The complaint further indicates that Deshmukh had to spend an additional Rs.9,500 on a replacement pair, which did not alleviate the emotional distress he experienced. He asserts that the incident resulted in not only physical pain but also mental agony, public embarrassment, and a loss of confidence.

The plea stated,

“The complainant holds the opponents responsible for these unfortunate circumstances. This present complaint is lodged against Gucci for selling defective products, causing physical injury, mental trauma, and failing to adhere to the standards of customer service expected of a renowned international brand,”

Deshmukh is seeking compensation of Rs.1.14 crore, citing deficiencies in service, unfair trade practices, and costs associated with mental distress and legal proceedings.

The matter is currently pending before the consumer commission for further action.
