“Irreparable harm will be caused”: Delhi Court restrains FoodInfotech from copying FoodTechBiz content

A Delhi court has restrained FoodInfotech from publishing plagiarised articles and photos taken from rival FoodTechBiz, citing copyright infringement. Judge Hemani Malhotra held that urgent relief was needed to prevent “irreparable harm” to the plaintiffs.

New Delhi: A Delhi court has passed an important order restraining Stand Point Media (OPC) Pvt Ltd, the company that operates FoodInfotech.com, from publishing articles and photographs which are alleged to have been copied from rival website FoodTechBiz.com.

This interim order was issued on a petition filed by FoodTechBiz (OPC) Pvt Ltd and its founder-editor Mandeep Kaur. They claimed that the defendants had been indulging in “deliberate, intentional and continuing infringement” of their copyright.

The matter was heard by District Judge Hemani Malhotra at Patiala House Courts. While granting an ex-parte ad interim injunction in favour of FoodTechBiz, the judge noted:

“The plaintiffs have made out a prima facie case and balance of convenience in their favour. Irreparable harm will be caused to the plaintiffs if urgent relief is not granted.”

FoodTechBiz, which is a B2B digital platform covering the food, beverage, packaging and food technology sectors, alleged that FoodInfotech not only chose a deceptively similar name but also began copying its exclusive content as early as 2022.

According to the plaintiffs, FoodInfotech had even assured them in April 2022 that corrective steps would be taken, but despite this promise, the alleged copying continued.

FoodTechBiz highlighted a recent example from May 2025 when it was exclusively invited to cover the prestigious IFFA Fair held in Frankfurt, Germany.

Its founder-editor Mandeep Kaur conducted and published exclusive interviews with Irene Plats, Global Marketing & Sustainability Director at Essentia Protein Solutions, and Ankit Doshi, Director of Vishakha Polyfab Pvt Ltd, along with original photographs from the event.

The plaintiffs alleged that shockingly, the very next day, FoodInfotech copied these interviews and photographs with only superficial changes and published them as its own stories.

A legal notice dated May 19 was then served to FoodInfotech. The defendants acknowledged the notice but allegedly did not take any action. The plaintiffs told the court that the defendants continued to engage in plagiarism despite being warned.

FoodTechBiz argued that the conduct of the defendants was not only a clear copyright violation but also resulted in loss of business opportunities, confusion among clients, and dilution of the FoodTechBiz brand identity.

The plaintiffs produced comparison charts, original material and emails before the court to establish their case. After reviewing these documents, Judge Hemani Malhotra concluded that immediate protection was necessary. She directed FoodInfotech to remove and disable the infringing content, including the articles:

The court has also issued summons to FoodInfotech in the main suit, along with notice of the injunction application, which has been made returnable on October 10.
