Excise 'Scam' Case | Delhi Court Set to Hear Arvind Kejriwal's Bail Plea Today

DELHI: Today(on 14th June), Delhi court has set to hear of Chief Minister Arvind Kejriwal‘s bail plea in the excise policy case. The decision came after an extensive discussion between the legal representatives of both parties, highlighting the procedural intricacies involved in the case.

On June 7, senior advocate Hariharan, representing Arvind Kejriwal, informed the Rouse Avenue court that the Enforcement Directorate (ED) had submitted its response to the bail plea just before the hearing.

“The response was submitted at the last minute, leaving us insufficient time to prepare.”

-Hariharan stated.

He further requested the court to list the case for the following week before a vacation judge, noting that the Rouse Avenue court would be closing for a summer break from June 8 until the end of the month.

However, Additional Solicitor General (ASG) Raju Ramachandran, appearing for the ED, expressed his inability to attend the hearing the following week.

“I will be unavailable next week.”

– Ramachandran conveyed to the court, urging that the case be listed for the week after instead.

This proposal was met with resistance from Hariharan, who argued-

“Another week of adjournment without a hearing would be prejudicial to Kejriwal.”

He emphasized the urgency of the matter and the potential impact of further delays on his client.

On June 5, in a notable development in the ongoing excise policy case, the court refused to extend the interim bail of Chief Minister Arvind Kejriwal, citing the need for further diagnostic tests before making any decisions regarding his release. Kejriwal, who has been under the scanner following allegations of evasion and non-compliance, saw his judicial custody extended until June 19. During this period, he is scheduled to appear before a vacation judge.

Judge Kaveri Baweja, presiding over the case, stated-

“I have issued specific directions for his diagnostic tests to be conducted.”

This statement underscores the court’s approach to prioritizing Kejriwal’s health while ensuring that legal proceedings are not unduly disrupted.

Kejriwal’s arrest by the Enforcement Directorate (ED) in late March marked a significant turn in the excise policy investigation. The arrest followed his failure to respond to nine summons for questioning, raising serious concerns about his cooperation with the legal process.

The Chief Minister initially challenged the validity of his arrest, leading to a temporary reprieve when the Supreme Court granted him interim bail on May 10 to allow him to campaign for the general election.

However, the situation took another turn when Kejriwal sought a seven-day extension of his interim bail on medical grounds. On May 29, the Supreme Court registry declined to list his plea for an extension, emphasizing that the court had granted him the liberty to approach the lower court regarding his bail. Consequently, Kejriwal surrendered to the authorities on June 2.
