Delhi Court Denies Custody Parole to Baramulla MP Rashid Engineer to Attend Parliament Session

Today, On 10th March, A Delhi court rejected the custody parole plea of Baramulla MP Engineer Rashid, who sought permission to attend the upcoming Parliament session. Additional Sessions Judge Chander Jit Singh dismissed the plea, stating no grounds for relief. The court has scheduled the hearing for Rashid’s regular bail plea on March 19. The decision impacts Rashid’s ability to participate in legislative proceedings.

New Delhi: Delhi’s Patiala House Court denied the custody parole application of Baramulla MP Rashid Engineer on Monday. The J&K MP sought parole to attend the upcoming Parliament session.

Additional Sessions Judge Chander Jit Singh dismissed the application and scheduled a hearing for Rashid’s regular bail plea on March 19.

The court previously requested a response from the National Investigation Agency (NIA) regarding the plea on March 3, reserving its decision after hearing arguments. Rashid’s application, submitted by advocate Vikhyat Oberoi on February 27, argued that as a parliamentarian, he needed to attend the session to fulfill his public duties.

Sheikh Abdul Rashid, also known as Engineer Rashid, won against Chief Minister Omar Abdullah in the 2024 Lok Sabha elections in Baramulla. His regular bail petition is still pending.

The judge granted Rashid interim bail on September 10 to allow him to campaign for the Jammu and Kashmir assembly elections, after which he surrendered to Tihar Jail on October 27.

Rashid has been incarcerated in Tihar Jail since 2019 after his arrest by the NIA under the Unlawful Activities (Prevention) Act in a 2017 terror funding case. The elections for the 90-member Jammu and Kashmir assembly took place in three phases from September 18 to October 1, with results announced on October 8, where the National Conference-Congress alliance secured a clear majority with 48 seats.

On February 24, the Delhi High Court instructed the sessions judge to expedite Rashid’s bail plea. His name emerged in the investigation of Kashmiri businessman Zahoor Watali, who was arrested by the NIA for allegedly funding terrorist organizations and separatists in the Kashmir Valley.

The NIA filed charges against several individuals, including Kashmiri separatist leader Yasin Malik, Lashkar-e-Taiba founder Hafiz Saeed, and Hizbul Mujahideen chief Syed Salahuddin, in connection with the case.

Rashid has been incarcerated in Tihar jail since 2019 after being arrested by the NIA under the Unlawful Activities (Prevention) Act (UAPA) in connection with a 2017 terror funding case.

The Jammu and Kashmir Assembly elections, comprising 90 seats, were conducted in three phases between September 18 and October 1, with the National Conference-Congress alliance winning 48 seats, as announced on October 8.
