2020 Delhi Riots | ‘Further Probe Is Required’: Court Orders FIR Against Delhi Minister Kapil Mishra & Others

Today, On 1st April, A court ordered the lodging of an FIR against Delhi Minister Kapil Mishra and others in connection with the 2020 Delhi riots. The judge found a prima facie case and directed further investigation into the matter. Mishra and others are accused of inciting violence during the riots. The court’s decision marks a significant development in the ongoing legal proceedings related to the riots.

New Delhi: A Delhi court ordered the registration of an FIR against Delhi cabinet minister Kapil Mishra and others to investigate his alleged involvement in the 2020 Delhi riots.

Additional Chief Judicial Magistrate Vaibhav Chaurasia found a “prime facie” cognizable offense that necessitates further investigation.

The judge noted,

“It is clear that Mishra was in the area at the time of the alleged offense; further probe is required.”

The court was considering arguments on a plea filed by Yamuna Vihar resident Mohammad Ilyas, who sought the FIR’s registration, a request that was opposed by the Delhi Police, which claimed Mishra had no role in the riots.

The case initiated following a complaint from the returning officer, leading to the registration of an FIR.

Additional Chief Judicial Magistrate Vaibhav Chaurasiya has ordered the Deputy Commissioner of Police (DCP) for northwest Delhi to present the report by April 18.

During the proceedings, the judge granted Mishra an exemption from appearing in court in person, citing his commitments to cabinet meetings for the upcoming budget sessions.

The judge concurred with the magisterial court that the complaint from the returning officer justified taking cognizance of the offense under Section 125 of the Representation of the People Act, which addresses promoting enmity between classes in connection with elections.

Kapil Mishra is an Indian politician and a member of the Bharatiya Janata Party (BJP). He has served as a Minister in the Government of Delhi and has been an influential figure in the city’s politics. Mishra gained widespread attention for his controversial remarks and actions during the 2020 Delhi riots.

He was accused of making inflammatory speeches that allegedly incited violence during the riots. Mishra has been a polarizing figure, with critics accusing him of contributing to communal tensions, while his supporters argue that he has been targeted for political reasons.
