[2018 Defamation Case]| Hearing Against Rahul Gandhi, Set for May 27: UP Court

Today, 14th May, The Uttar Pradesh court scheduled a hearing for May 27 in the 2018 defamation case against Rahul Gandhi. The case stems from remarks made by Gandhi during a rally in which he allegedly linked the RSS to the assassination of Mahatma Gandhi. The court’s decision will be pivotal in determining the legal ramifications of Gandhi’s statements.

Sultanpur: The hearing in a defamation case from 2018, which involves Rahul Gandhi and his alleged derogatory remarks towards Union Home Minister Amit Shah, scheduled for May 27. This comes after the appointment of a new judge to the special court handling the case.

The defamation complaint originally filed by BJP leader Vijay Mishra six years ago. Santosh Pandey, the advocate representing the plaintiff, confirmed that the matter would be heard on May 27.

However, Kashi Prasad Shukla, Gandhi’s lawyer, stated,

“The case could not be taken up earlier due to the absence of a judge for the MP/MLA court, which has now been resolved with the appointment of a new judge.”

In December of a previous year, a warrant issued against Rahul Gandhi by the court. Consequently, Gandhi interrupted his Bharat Jodo Nyay Yatra in Amethi on February 20 to appear in court, where he subsequently granted bail.

The defamation complaint initially filed on August 4, 2018, against Rahul Gandhi for his alleged objectionable comments about Shah during a press conference in Bengaluru in May of the same year, coinciding with the Karnataka elections. The complainant referred to Gandhi’s statement, where he accused the BJP of claiming to uphold honest and clean politics while having a party president who was an “accused” in a murder case. It is worth noting that Shah the BJP president at the time Gandhi made the comment.

It is pertinent to mention that four years prior to Gandhi‘s remark, a special CBI court in Mumbai acquitted Shah in a 2005 fake encounter case that occurred during his tenure as the minister of state for home in Gujarat.

This legal battle is part of a series of challenges Gandhi faced, which critics argue are politically motivated to undermine his credibility and political influence. The 2018 defamation case specifically stems from comments made by Gandhi that interpreted as derogatory towards a particular community or an influential entity, leading to legal action under the sections of the Indian Penal Code that address defamation.
