26/11 Accused Tahawwur Rana Again Appeals to US Supreme Court Chief Justice to Stop Extradition to India

According to the official website of the US Supreme Court, the court has set a conference for April 4, 2025, to review his new application. Rana has renewed his request for a stay on his extradition to India.

Tahawwur Rana, who is accused in the 26/11 Mumbai terror attacks case, has once again approached the US Supreme Court. He has filed a fresh request with US Supreme Court Chief Justice John Roberts, seeking to stop his extradition to India. This comes after his previous appeal was rejected earlier this month by US Supreme Court Justice Elena Kagan.

According to the official website of the US Supreme Court, the court has set a conference for April 4, 2025, to review his new application. Rana has renewed his request for a stay on his extradition to India.

His appeal states: “Petitioner Tahawwar Rana has renewed his Emergency Application for Stay Pending Litigation of Petition for a writ of Habeas Corpus previously addressed to Justice Kagan and requests that the renewed application be directed to Chief Justice Roberts, according to the order published on the US Supreme Court’s website.”

Previous Appeal to Stop Extradition to India

Earlier this month, Justice Elena Kagan had denied Rana’s request for a stay on his extradition. In his appeal, Rana argued that his health condition is critical, and he may not live long enough to face trial in India.

He stated, “If a stay is not entered, there will be no review at all, and the US courts will lose jurisdiction, and the petitioner will soon be dead.”

Rana has claimed that if he is extradited to India, he could face torture because of his background. He has highlighted that he is a Muslim of Pakistani origin and a former member of the Pakistani Army. He also mentioned that the charges related to the 2008 Mumbai attacks put him at serious risk.

He argued in his application that “his Muslim religion, Pakistani origin, status as a former member of the Pakistani Army, the nature of charges to the 2008 Mumbai attacks, and his chronic health conditions, would significantly increase the risk of torture against him, and that torture could result to his death in a short period.”

He further stated that he cannot be sent into a “hornet’s nest,” where he will be targeted due to “national, religious, and cultural animosity.”

US President Announced Rana’s Extradition

Earlier in February, former US President Donald Trump had announced that Tahawwur Rana would be extradited to India. Trump made this announcement during a joint press conference with Indian Prime Minister Narendra Modi after their bilateral meeting earlier this year.

Rana is currently fighting his extradition in the US courts, fearing he may face severe consequences if he is sent to India to stand trial for his alleged involvement in the 26/11 Mumbai terror attacks.
