Protocol of Chief Justice is Higher Than That of a Governor: Former CJI Gavai Rejects Governor Post After Retirement

NEW DELHI: Chief Justice of India (CJI) B.R. Gavai officially retired on Sunday, ending a judicial career that spanned over four decades. On the eve of his retirement, CJI Gavai made headlines with a strong statement: he will never accept any post after retirement, including the position of a state Governor.

“No, never. The protocol of the CJI is higher than that of a Governor.”

When asked whether he would ever consider taking up the role of Governor, a position once held by his father, Gavai firmly rejected the possibility. He emphasized that the position of Chief Justice of India has a higher protocol than the Governorship, and thus, he would not seek or accept such an office.

Gavai also stated that he wishes to contribute to the welfare of tribal communities and plans to remain based in Delhi after retirement.

Speaking to the media, CJI Gavai expressed concern over the increasing instances of hate speech in India. While emphasizing that it is ultimately for the government’s decision, he said that a dedicated law addressing hate speech is necessary to tackle the rising issue.

On his final working day, Friday, Justice Gavai received an emotional farewell. He described his exit from the institution with “complete satisfaction”, calling himself a “student of justice” as he concluded 40 years of service as a lawyer and judge.

Notably, Gavai was also the second Dalit judge in Indian history to serve as Chief Justice of India, after Justice K.G. Balakrishnan.

Justice Surya Kant took oath as the 53rd Chief Justice of India today (Monday). He was appointed the next CJI on October 30 and will serve for approximately 15 months, retiring on February 9, 2027, upon turning 65.
