Union Home Minister Amit Shah said any action against Justice Shekhar Kumar Yadav over his hate speech will be decided by the Supreme Court. He clarified that the matter does not fall under the government’s jurisdiction or control.
Union Home Minister Amit Shah stated that any action regarding Justice Shekhar Kumar Yadav of the Allahabad High Court, who was accused of making a hate speech, will be determined by the Supreme Court.
He emphasized that this matter does not fall under the government’s jurisdiction and highlighted that corruption and hate speech should not be treated similarly.
Amit Shah also mentioned that there are no intentions to impeach Justice Yashwant Varma, from whose residence a big amount of cash was discovered. He noted that the Chief Justice’s letter clearly indicated Justice Varma’s guilt and that severe actions would be taken against corruption.
Reports have surfaced suggesting that the Supreme Court dropped the investigation into Shekhar Kumar Yadav following unusual interference from the Rajya Sabha Secretariat. The Secretariat contended that the Supreme Court lacked the authority to investigate a judge and sent an unusual letter to this effect in March.
In December of the previous year, Shekhar Kumar Yadav attended a VHP (Vishva Hindu Parishad) event where he delivered a hate speech, asserting that “the majority community should rule the country.”
His comments sparked controversy, leading the Supreme Court Collegium to summon him for an explanation. Yadav maintained his position during this meeting, stating he would not retract his remarks. As a result, the Supreme Court decided to initiate an internal inquiry and take appropriate measures.
Following this, the Rajya Sabha Secretariat sent a letter claiming that the Supreme Court had no jurisdiction to investigate Yadav.
The Supreme Court subsequently stayed the investigation based on this correspondence. Legal experts, however, argue that the Rajya Sabha Secretariat does not have the authority to issue such a letter, and they consider the Supreme Court’s decision to cease the investigation based on it as erroneous.
