CJI B R Gavai’s Bold Warning to Safeguard Democracy: “Judicial Activism Must Not Become Judicial Terrorism, Adventurism”

CJI B R Gavai’s Bold Warning to Safeguard Democracy: “Judicial Activism Must Not Become Judicial Terrorism, Adventurism”

MAHARASHTRA: Chief Justice of India B R Gavai, who recently took oath as the 52nd Chief Justice, made an important speech during a felicitation program held by the District Court Bar Association.

While addressing the gathering, he gave a strong message about the role of the judiciary in India and the need to maintain balance among the three branches of democracy.

He said-

“All the three wings of the Indian democracy- legislature, executive and judiciary- have been given their limits and boundaries. All the three wings have to work as per law and its provisions. When the Parliament goes beyond the law or rule, the judiciary can step in then.”

Justice Gavai clearly explained that the judiciary has a right to act when the other branches overstep their limits. However, he also gave a warning that this power should not be misused or taken too far.

He said-

“However, I always say that though judicial activism is bound to stay, it should not be permitted to be converted to judicial adventurism and judicial terrorism.”

He made it very clear that judicial activism, which means judges taking steps to protect the Constitution and the rights of citizens, is important. But, it should not go so far that it becomes harmful or extreme.

Justice Gavai also paid respect to Dr B R Ambedkar, calling him a great social reformer and legal thinker. He said the country must always be grateful for Dr Ambedkar’s contributions.

He also praised the diversity and unity of the Nagpur bar, calling it the most inclusive and secular bar he had seen.

He added-

“The Nagpur bar association is the most secular bar with members from all castes and religions”

and also said he had personally witnessed-

“Hindu lawyers working for the cause of the Muslim community and vice versa.”
